Larius Kogoya, Jayapura, Jubi – The President of the Republic of Indonesia, Prabowo Subianto, is being urged to establish an institution to handle alleged human rights violations in Papua, such as a Truth and Reconciliation Commission (KKR) and a Human Rights Court.
Papua Human Rights Lawyers Association (PAHAM Papua) Director Gustaf Kawer stated that the establishment of a KKR and Human Rights Court in Papua is mandated by Article 45 of the Special Autonomy Law (Otsus) on Papua in upholding, advancing, protecting and respecting the human rights of indigenous Papuans.
"In accordance with the mandate of the Otsus Law, institutions that have not yet been established include the Human Rights Court in (the land of) Papua and a KKR in (the land of) Papua. These must all be established for the resolution of human rights violations in terms of the past in the land of Papua", Kawer told Jubi on Tuesday July 8.
Professor Melkias Hetharia, SH, MH, from the Cenderawasih University Faculty of Law, says that it is important to understand the concept of human rights first, because the concept of human rights is broad.
"So if we look here in relation to the Papua problem, right, the most prominent is civil and political rights. However, human rights are not just about civil and political violations, but also about economic, social and cultural rights," said Hetharia.
He said that the Otsus Law addresses various sectors that must be implemented. Equally important are those related to human rights violations, as regulated under Articles 45 and 46 of the law. Therefore, he believes it is necessary to establish a Human Rights Court in accordance with the instruments of the Otsus Law and a KKR.
