Vitorio Mantalean, Jakarta -– The People's Justice and Prosperity Party (PRIMA) is officially suing the General Elections Commission (KPU) at the State Administrative Court (PTUN) after the KPU declared that the party had failed to pass the administrative verification to be a participant in the 2024 elections.
As quoted from the PTUN Jakarta's official website, PRIMA's law suit was registered on Wednesday November 30 under case number 425/G/2022/PTUN.JKT. The case is currently at the state of summoning the related parties.
In its law suit, PRIMA is asking the panel of judges at the PTUN Jakarta to grant all of their claims.
PRIMA is asking the judges to cancel or declare invalid the KPU's November 18 official report Number 275/PL.01.1-BA/05/2022 along with its attachments, which states that they failed the administrative verification. The judges are being asked to order to the KPU to revoke the report.
They are also asking the court to order the KPU to issue a new report declaring PRIMA to be a participant in the 2024 elections.
This is the second time that the KPU has declared that PRIMA has failed to pass the administrative verification. When it was first declared to have failed to meet the requirements, PRIMA challenged the KPU's decision with the Elections Supervisory Board (Bawaslu).
The Bawaslu hearing subsequently found in favor of PRIMA along with four other political parties, namely the Justice and Unity Party (PKP), the Voice of the Indonesian People's Party (Parsindo), the Republican Party and the Indonesian My Republic Party (PRI).
Bawaslu then ordered the KPU to allow PRIMA and the other four parties to again upload their data in order to fix their administrative verification.
The result however, was that on November 18 the five parties were again declared to have failed the administrative verification process.
PRIMA tried to again challenge the KPU's decision with Bawaslu but based on Bawaslu Regulation Number 9/2022, “Bawaslu follow-up decisions" cannot be used as the object of a dispute.
