Activist faces 1 year in prison for alleged incitement during August protests

Jakarta – Former ASEAN Inter-Parliamentary Assembly (AIPA) employee Laras Faizati Khairunnisa, who is facing a one-year prison sentence for allegedly inciting the August protests, insists she has not committed a crime.

She then compared the one-year sentence demanded by the public prosecutor (JPU) to the police officers who ran over and killed online motorcycle taxi driver Affan Kurniawan during a protest near the House of Representatives (DPR) in August who have still not yet been tried to this day. Meanwhile all she did was express anger over Kurniawan's tragic death.

"I must instead be prosecuted and must languish in prison for much longer than the individuals who ran over and killed [Kurniawan]. I didn't kill anyone, I didn't commit a crime, but I've have to, I've been in prison for four months, and it's as if they are very afraid of a woman's voice", Khairunnisa said at the South Jakarta District Court on Wednesday December 24.

Despite facing this injustice, Khairunnisa continues to encourage others who are also being prosecuted for alleged incitement during the demonstrations that turned into riots last August.

According to Khairunnisa, her colleagues who are suffering a similar fate as her are victims of criminalisation.

"May you remain steadfast in your fight for justice and freedom, and may our struggle today bear sweet fruit for the future of our nation and country", she concluded.

The Public Prosecutor has demanded that the panel of judges at the South Jakarta District Court sentence Khairunnisa to one year in prison.

The prosecutor stated that, based on the facts presented at trial, Khairunnisa should be found guilty of committing a crime related to incitement during the demonstrations that led to riots at the end of August, as stipulated under Article 161 paragraph 1 of the Criminal Code (KUHP).

"Hand down a sentence against the defendant Laras Faizati Khairunnisa of one year in prison, less the time the defendant has been detained with an order that the defendant remain in detention", said the prosecutor when reading the indictment at the South Jakarta District Court on Wednesday.

According to the prosecutor, Khairunnisa should be found guilty of broadcasting, displaying or posting in public writing inciting others to commit criminal acts, opposing public authority with violence or opposing other things else as referred to in the above article, with the intention of making the inflammatory content known or more widely known to the public.

The alleged crime occurred on Friday August 29, 2025, at around 5 pm Western Indonesian Time (WIB) and coincided with the massive demonstrations in that ended in riots.

One of Khairunnisa's social media posts that was deemed seditious was when she reposted a 1-minute-32-second video with the following text in English:

"Most corrupt, most useless, most sickening, disgusting, stupid, and morally bankrupt institution EVER. Fuck the police, you are literally just a bunch of dumfucks, and I hope every single one of you and your bloodline rots in the deepest hell."

Translated into Indonesian this means: "lembaga paling korup, paling tidak berguna, paling menjijikkan, paling bodoh dan paling bangkrut secara moral yang pernah ada. Persetan dengan polisi, kalian benar-benar hanya sekelompok orang bodoh dan kuharap kalian semua dan garis keturunan kalian membusuk di neraka terdalam", stated the prosecutor in the indictment.
