Andi Saputra, Jakarta – Presidential candidate Prabowo Subianto and running mate Sandiaga Uno are challenging the results of the 2019 presidential election which was won by incumbent President Joko “Jokowi” Widodo and running mate Ma’ruf Amin.
A number of pieces of evidence and links to news reports have been submitted, including postings from Twitter and Instagram accounts.
“That there indications of bias by Polri [national police], that there are strong suspicions that Polri as an institution established a social media buzzer team to support the Joko Widodo-Ma’ruf Amin election ticket”, read page 18 of the challenge as quoted by Detik.com on May 27.
The legal team gave as an example leaked information uncovered by the Twitter account @Opposite6890 which compiled a video narration titled Police buzzer teams 100 people per Polres [district police] throughout Indonesia organised from Polres to Mabes [national police headquarters].
“It was noted that the police buzzer parent account was named ‘Alumni Sambhar’ whose address is it at Mabes Polri”, they said.
Also according to Prabowo’s legal team, which is headed up by Bambang Widjodjanto, the Instagram account @AlumniShambar only follows one account, namely the Instagram account belonging to President Widodo.
“So the indications of police bias are clear. In addition to this, the application APK Smabhar uses an IP address belonging to Polri where it was obligatory for the application to be installed by Polri buzzers on their individual Android devices”, he said.
Based on the General Election Commission (KPU) count, the Widodo-Amin presidential ticket received 85,607,362 valid votes while the Prabowo-Sandiaga ticket received 68,650,239 valid votes with 16,957,123 left over.
The Prabowo-Sandiaga ticket has not accepted this and is challenging the election result with the Constitutional Court.
“Ordering the respondent (the KPU – Ed) to immediately issue a decision naming H Prabowo Subianto and H Sandiaga Salahudin Uno as president and vice president elect for the period 2019-2024 or ordering the respondent (KPU) to hold the elections again in an honest and fair manner throughout the territory of Indonesia, as mandated Under Article 22e Paragraph 1 of the UUD 1945 [Constitution]”, reads the Prabowo-Sandiaga Constitutional Court challenge.
In order to prove this, they included scores of pieces of evidence, among which were links to online media reports.
“Get with the times. Article 5 Paragraph 1 of the UU ITE [Information and Electronic Transactions Law] clearly states that electronic information and/or its copies can be used as legal evidence. The UU ITE has been in effect for almost 10 years and there have been hundreds of cases that were decided using links to news articles”, said Prabowo-Sandiaga election campaign team legal and advocacy directorate member Habiburokhman.
