Shela Octavia, Dita Angga Russa, Jakarta – The Civil Society Coalition is asking President Prabowo Subianto to issue a Government Regulation in Lieu of Law (Perppu) to cancel the revised Criminal Procedure Code (KUHAP) which has just been passed into law by the House of Representatives (DPR).
"We are providing input, urging Prabowo to immediately issue a Perppu, cancel this KUHAP immediately because it endangers law enforcement", said Indonesian Legal Aid Foundation (YLBHI) Chairperson and Coalition member Muhammad Isnur in a discussion at the YLBHI offices in Jakarta on Saturday November 22.
Isnur said that in the new KUHAP there are a number of problematic articles. This is because some of them actually eliminate the authority of civil servant investigators (PPNS) and specific investigators in carrying out law enforcement.
Isnur believes that this article are very dangerous for the law enforcement agenda in several specific cases, one of which is the eradication of drugs. "Because BNN [National Narcotics Agency] investigators will lose their authority to arrest and detain without orders from Polri [National Police] investigators", continued Isnur.
This weakening of BNN also conflicts with the Asta Cita program promoted by the Subianto and Vice President Gibran Rakabuming Raka administration. It is known that point 7 in Asta Cita touches on the eradication of drugs.
"Strengthening political, legal and bureaucratic reforms, as well as strengthening the prevention and eradication of corruption and drugs", reads point 7 in the Asta Cita.
The Civil Society Coalition believes that all PPNS and specific investigators will be affected by the KUHAP which places Polri investigators as the main investigators.
"This is extraordinary carelessness, yeah, a scheme with an ambitious spirit to introduce a monopoly of authority but has the effect of killing certain investigative agencies", Isnur reiterated.
