Jakarta – The Civil Society Coalition for the Renewal of the Criminal Procedure Code (KUHAP) has compiled a counter draft of the Draft KUHAP (RUU KUHAP) as a form of resistance to the House of Representatives (DPR) and the government’s version of the RUU KUHAP.
According to the Coalition, during the legislation process, the official draft of the RUU KUHAP has shown an authoritarian tendency, expands the authority of the law enforcement agencies without effective control and reduces the role of victims, legal advocates and citizens in the criminal justice process.
"Considering the greater interest for the protection of citizens' rights from the threat of abuse of power through the Criminal Procedural Law, the Coalition has compiled a counter draft of the RUU KUHAP, a Civil Society Coalition for the Renewal of the Criminal Procedure Code version to accommodate guaranteed due process of law and the protection of human rights", said the Coalition in a statement on Friday July 11.
The Coalition said that the counter draft was arranged collectively and would continue to be developed by the Coalition. "This draft is legal counter-propaganda against problematic legislation. It is a call that criminal law should not be a tool for silencing [dissent], but a guarantee of human dignity and social justice", the Coalition said.
In addition to this, the coalition will also continue to call for the discussions on the RUU KUHAP during the current parliamentary sitting period to be carried out in depth and substantially, not in a rush, but carefully and applying the principle of meaningful participation.
Earlier on Thursday July 10, the DPR's Commission III together with the government officially completed the discussions on the RUU KUHAP's Problem Inventory List (DIM).
The discussion on as many as 1,676 DIM items was completed in just two days since Wednesday July 9. Of that number, as many as 1,091 items in the DIM are permanent and 295 editorial.
"Thus the substance of the new DIM has been completed, yes. Applause for the government representatives", said RUU KUHAP working committee chairperson Habiburokhman from President Prabowo Subianto's ruling Greater Indonesia Movement Party (Gerindra).
Habib, as he is known, then explained that out of a total of 1,676 DIM items, 68 were amended, 91 were deleted and 131 have new substances. After completing the discussions on the DIM, the discussion of the RUU KUHAP will then enter the synchronisation stage. (fra/yoa/fra)
